Laws against discrimination in Mozambique

The laws in Mozambique protect employees and potential hires from unequal or unfair treatment during the recruitment process and beyond. Under the constitution and the country’s employment laws, employers cannot discriminate on the basis of:

Employers will need to keep these protected characteristics in mind and avoid asking any directly related questions during the recruitment process — even during casual conversations and small talk with prospective employees. How to hire employees in Mozambique

Although Portuguese is the official language in Mozambique, locals speak many indigenous languages depending on the region. You should hire an interpreter, work with a consultant, or hire employees who speak these languages so that you can successfully recruit Mozambique employees.

Every person you hire needs an employment contract unless it’s a fixed-term contract for fewer than 90 days. Contracts must get dated and signed by both parties and include information about the job, workplace, contract duration, salary, and more. Mozambique employment compliance laws allow three different types of employment contracts — permanent, fixed-term, and unfixed-term. Always research the contract that best fits your open positions and hiring needs before discussing how to hire Mozambique employees.

Mozambique employment laws

Mozambique’s Labor Code includes the country’s employment compliance laws and dictates employment relationships. However, some industries may have collective bargaining agreements (CBA) that act as complementary legislation. In these industries, you should follow the CBA’s regulations, as they may be more expansive than what’s outlined in the Labor Code.

Another important employment compliance law is Mozambique’s workweek limit. Standard hours of work are eight hours daily or 48 hours weekly. Working hours can be extended to nine hours per day if the employee receives an extra half-day of rest. Regular work time cannot exceed 54 hours a week. Overtime is permitted up to 200 hours per year but cannot exceed eight hours per week or 96 hours in a quarter. Overtime hours are paid at a rate of 150% of normal pay for time worked before 8 p.m. Hours after 8 p.m. and time worked on rest days and holidays are paid at a rate of 200%.
