Fixed-term contracts are permitted in Eswatini. It’s legally required to put a written employment contract in place, in the local language, which spells out the terms of the employee’s compensation, benefits, and termination requirements. Working hours in Eswatini

The work week should not exceed 5.5 days. Employees can work overtime, but they must consent to perform the extra hours. All employees working overtime must get paid at least 1.5 times their normal rate.

Expecting employees are generally entitled to 12 weeks of maternity leave, 6 of which may be taken before the due date. As long as the employee has worked for at least 1 year with a company, 2 weeks of the leave are paid.

Termination/severance in Eswatini

Probationary periods of up to 3 months are permitted. Employees engaged to perform supervisory technical or confidential work may have a longer probationary period, but it must be agreed to in writing.

Employers may terminate employees with the following notice periods:

  • After the probationary period and 1 month of employment: 1 week of notice
  • 3 to 12 months of employment: 2 days for each completed month of continuous employment
  • More than 12 months of employment: 1 month plus 4 days for each completed year

Departing employees may be paid in lieu of notice. As noted in the labor laws, a terminated employee is eligible for severance pay of 10 working day’s wages for each completed year of service after the first year.

Paying taxes in Eswatini

There is no social security tax in Eswatini. The income tax system is pay-as-you-earn (PAYE).
